THE PROCESS OF ISSUING A POWER OF ATTORNEY AND BASIC REQUIREMENTS

  • How is a Power of Attorney granted?

    To give power of attorney to your lawyer, you need to apply to a Notary Public in any province of Turkey. Our clients living abroad can issue the power of attorney through the Consulates of the Republic of Turkey.
  • Information and Documents Required When Issuing a Power of Attorney

    Below is what you should have with you during the application to the notary and the lawyer information that should be included in the power of attorney:

    • Identity Information (What the client should bring)
    • T.R. Identity Card/National Identity Card or Passport
    • Tax Identification Number (If available)
    • If you are a Legal Entity (Company): Signature Circular, Stamp
    • Additional Information: According to the Type of Power of Attorney
    • Divorce Cases: 2passport-sizee photographs are mandatory.
    • Companies: Signature circular, tax certificate, and authorization certificate (showing that the person who will give power of attorney is authorized) are required.
    • Real Estate Sales: The title deed information of the real estate is required for the power of attorney authorizing the sale.

  • Types of Power of Attorney

    Depending on the purpose of the principal and the nature of the case, the power of attorney is divided into two main types:

    General Litigation Power of Attorney:
    It is valid for all legal transactions, including divorce, execution, trade, rent, and inheritance.
    It is the most commonly used type. It allows your lawyer to have broad powers on your behalf.

    Special Power of Attorney:
    Issued only for certain, specific transactions. For example: Transfer of title deeds, incorporation of a company, oaths, settlements, and releases. The general power of attorney is insufficient. Therefore, consult your lawyer before starting the process for situations that require special authorization.

CRITICAL INFORMATION AND SPECIAL SITUATION FOR FOREIGNERS

  • Issuance of Power of Attorney from Abroad

    Turkish and foreign clients residing abroad can obtain a power of attorney through the Consulate of the Republic of Turkey in their country of residence. If there is no consulate, the power of attorney must be issued at the local notary public and then certified with an apostille.
  • Requirements for Foreign Clients

    When issuing a power of attorney for foreign clients:
    The Turkish translation of the passport must be presented to the notary public.
    The notary must use a sworn translator during the issuance of the power of attorney. The translator's cost is the client's responsibility.

    Important Note: To ensure the power of attorney (translation for foreigners) covers all types of cases, it is recommended that you contact our office before going to the notary to request the draft text and the necessary lawyer information.
